    50% deposit required securing date.

    RESERVATION
    Upon your signature, Newfound Photography will reserve the time and date agreed upon, and will not make other reservations for that date and time. For this reason, the reservation deposit is non-refundable, even if the date is changed or wedding cancelled for any reason, including acts of God, fire, strike, and extreme weather. The reservation deposit is to be paid at time of signing the contract. The reservation deposit is applied towards the contracted Wedding Package. Client understand and agrees that the entire amount owed for the Wedding Package described in the contract is due 14 days before the Wedding Day. Client agrees if the balance is not paid by this time, the Photographer will not photograph the Wedding Day described on the contract, with a loss of the Reservation Deposit by Client, and no liability to the Photographer.

    PRE-EVENT CONSULTATION
    The parties agree to a pre-event consultation either in person or via email before the wedding day in order to finalise the actual shooting times, locations, and clients request list for specific photographs. The Client will be responsible for, or have someone designated, to identify people of whom specific photographs are desired. The Photographer will not be held accountable for not photographing desired people if there is no one to assist in identifying people or gathering people for group photographs.

    WEDDING PARTY CO-OPERATION
    Both parties agree to cheerful co-operation and communication for the best possible result within the definition of this assignment. The Photographer is not responsible if any key individuals fail to appear, fail to co-operate during photography sessions, or for failure to capture images due to details not reeled to the Photographer. The Photographer recommends the Client designate an "event guide" to point out any important individuals for informal or candid photographs to the Photographer during the wedding day

    EVENT GUIDE
    It is the responsibility of the Event Guide/Planner or other designated person to inform Photographer when the next major event is about to take place (eg. Starting of Ceremony, Grand Entrance, First Dance, Cake Cutting, Toss of Bouquet and Garter, Exit - no such shots are guaranteed). In Addition, Event Guide/Planner/Designated Person shall be responsible for organising and tracking all posed photographs that are desired. Photographer cannot be responsible in organising and tracking all of the groups.

    RECEPTION AND EXIT
    If desired, Photographer will cover Reception until time coverage is up. If the Client desires Photographer to stay extra time, time will be charged by the hour at $200 per hour. The amount will be due prior to receiving final edited images. Photographs will not be delivered until Newfound Photography is paid in full.

    EXCLUSIVITY
    Newfound Photography shall be the exclusive photographer retained by the clients for the purpose of photographing the contracted event. Persons at the event shall be permitted to photograph the event as long as they shall not interfere with Photographer's duties. A Videographer may appear and participate, but Client acknowledges and agrees that Photographer shall be provided location priority and shot priority over any videographer. Photographer will not be responsible for any coverage missed or blocked because of videographer equipment or interference. No additional Photoshopping will be used to remove any equipment or persons from the frame.

    DIGITAL NEGATIVES, PRINTS AND COPYRIGHTS
    The photographs, digital negatives or prints produced by the photographer are protected by International Copyright Law (all rights reserved) and the photographer retains copyright to all photos and images produced. The client may reproduce any images in any manner they like for sharing and enjoyment of friends and relatives. However, the client must obtain written permission from the photographer prior to the client or their friends and relatives or wedding vendors publishing or selling the photographs for profit.

    MODEL RELEASE
    The Photographer may ask the Client for permission to use and publish photographs of the Client or in which the Client may be included, for editorial, trade, advertising, competition and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client releases all claim to profits that may arise from use of images.

    RESCHEDULE/CANCELLATION
    In the event that the Client reschedules the wedding and Photographer is available on the rescheduled date, a booking fee may be charged for the change. The remainder of the retainer will be applied to total fee owed. Both the photographer and the client must sign a new contract. If the photographer is unavailable for the new date, then the reschedule will be treated as a cancellation and the client shall forfeit the retainer in its entirety. In the event that the client cancels the wedding, client will forfeit the retainer. Photographer must receive all notification of cancellation in writing.

    INDEMNIFICATION
    Client hereby acknowledges that Photographer may be limited by the guidelines or rules of the official performing the ceremony or the venue, and to hold Photographer harmless for the impact such restrictions may have on the final product.

    LIMITATION OF LIABILITY
    Photographer’s entire liability for any claim, loss, damage or injury arising under or relating to this agreement is limited to the fees paid by the client for the services. In no event shall the Photographer be liable for special, incidental, consequential, or punitive damages, even if Client informs Photographer of circumstances that would give rise to such damages.

    DELIVERY OF IMAGES
    The images will be delivered within 8 weeks of date of event. Images will be in digital format on an online gallery, and edited/processed as Photographer sees fit. Edit will be in the artistic style of Newfound Photography, and subtle fixes in regards to exposure, white balance, contrast and colour grading will be made. This does not include extra "Photoshopping" to remove persons, objects, changes to skin/tan lines, changes to wardrobe/makeup, or editing images for subjects to look "thinner".

    CLIENT USAGE RIGHTS
    Client is forbidden from editing any photograph, except for cropping or exposure. Client is given full print rights for life on any and all digital images given back in email, online gallery or USB. Clients understand that these images are mainly for personal use. If images are shared with any business including Clients' or vendor from event to use as marketing, or on social media, Photographer must be asked for permission prior to use.

    PROTECTION OF DELIVERABLES/RETENTION OF FILES
    Photographer shall take all reasonable steps to protect the images that are recorded at the Event until such time as the final product is delivered to Client. Whilst all efforts will be made from the photographer to safeguard and backup the files, once the digital product has been delivered, Photographer shall have no further obligation to preserve the images of the Event, regardless of the form of media in which they are stored. I confirm that I have read and understood this contract, and I agree to enter into this contract with Newfound Photography.
